Bipin Adhikari[edit]

Bipin Adhikari is a constitutional expert and public intellectual in Nepal.[1] He is currently a Professor of Law at the Kathmandu University School of Law (KUSOL) and was its founding dean in December 2013.[2][3] Adhikari has notable academic and professional interests in constitutional law, public policy, institution-building, human rights, access to justice, infrastructure development, legal reforms, good governance, and the democratization process.[4] Adhikari's opinions on contemporary constitutional issues are consistently sought after by Nepalese media.[5][6]

Adhikari is a member of the Supreme Court Bar Association and the Constitution Watch Group, a network of independent experts committed to the Constitution of Nepal and its institutionalization.[7] Since 2016, Adhikari has been a fellow of the International Academy of the Belt and Road Initiative based in Hong Kong. Adhikari was honored by the Annapurna Express, a leading Nepali broadsheet paper, as one of the 50 distinguished visionaries in Nepal for their contributions to Nepali society at a special function titled "Saluté" in Kathmandu on May 23, 2022.[8]

Early life and education[edit]

Adhikari was born and raised in Bastipur, better known as Lahan Municipality 12, in the Madhesh Province of Nepal.[9] He graduated from Tribhuvan University in Kathmandu in 1985 with a Bachelor of Law. Adhikari then earned a Master of Comparative Law, with a focus on Corporate Management and Law, from the Faculty of Law, University of Delhi in 1991, after which he went on to earn a PhD in Constitutional Law in 2001.[10] Prior to being awarded his PhD, Adhikari also received the Chevening Scholarship at Lancaster University in the United Kingdom, where he studied International Business and Finance Law.

Career[edit]

Adhikari was designated a senior advocate by the Supreme Court of Nepal in 2017.[11] Adhikari's career has included assignments with national and international agencies, including various United Nations (UN) entities, such as the United Nations Office for Project Services (UNOPS), the Office of the United Nations High Commissioner for Human Rights (OHCHR), the United Nations Development Programme (UNDP), and United Nations peacekeeping missions. He has previously served with the United Nations in Cambodia, Liberia, and Timor-Leste.

In 2009, Adhikari submitted a model constitution to the first Constituent Assembly to support its constitution writing process following the Nepalese Civil War.[12] In his capacity as a professor, Adhikari gave a TEDx Talk at Kathmandu University in June 2022, focusing on the need for an interdisciplinary approach to Nepali legal education and the general concerns for access to justice.[13]

Opinions on Contemporary Constitutional Legal Issues[edit]

Adhikari's public opinions strongly support constitutionalism, the rule of law, and liberal political causes in Nepal, earning him recognition as a leading voice in the area of constitutional law.[14] Recently, in the context of Truth and Reconciliation Process in Nepal, Adhikari argued against granting a general amnesty for human rights violations during conflicts, deeming it universally unacceptable.[15] He stresses the need for accountability to uphold transitional justice and prevent undermining justice and accountability principles, particularly in cases of serious violations.[16]

Academic engagements[edit]

As a founding dean of KUSOL, Adhikari focused on redefining legal education by introducing an interdisciplinary study of law and management. At KUSOL, Adhikari chairs the Management, Economics, and Law Subject Committee, which oversees all undergraduate and graduate programmes at KUSOL. He is also a member of KUSOL's Faculty Board, responsible for academic decision-making at the institution, and of the Kathmandu University Academic Council.[17][18]

Adhikari also currently serves as a member of the Tribhuvan University Faculty of Law Research Committee and is a law curriculum advisor to the Lumbini Buddhist University.[19] He is also a member of the Faculty Board of the School of Management and Law at Nepal Open University in Kathmandu.

He is a member of the Sagarmatha Sambad Steering Committee, a global dialogue programme of the Government of Nepal's Ministry of Foreign Affairs that discusses contemporary issues.[20] Furthermore, he serves as the Senior Expert Member of the Thematic Group on Political, Legal, and Social Affairs of the Policy Research Institute, the policy think tank of the Government of Nepal.[21]

Adhikari is the chief editor of Essays on Constitutional Law, published bi-annually by the Nepal Law Society. He recently edited A Treatise on the Constitution of Nepal 2015 (Kathmandu: Kathmandu University School of Law, 2020), an important contribution to the study of Nepal's new Constitution.[22] Additionally, his recent book, Salient Features of the Constitution of Nepal, 2015 (Kathmandu: Nepal Consulting Lawyers Inc, 2016), is the first commentary on Nepal's new Constitution, critically analyzing the reforms introduced under it.[23]

Contributions to B. P. Koirala's Work[edit]

Adhikari has contributed to the thoughts and work of B. P. Koirala, the prominent figure in the Nepalese revolution of 1950-1951 and the inaugural elected prime minister of Nepal. On his personal website, Adhikari has a dedicated section to B. P. Koirala, where Adhikari compiles a wealth of self-authored essays and articles .[24] Additionally, Adhikari operates an X account dedicated to Koirala, introducing him as "a renowned Nepalese statesman, former Prime Minister, ideologue, literary figure, and an iconic symbol of the Nepalese renaissance in the context of socio-economic, political, and philosophical transformation of Nepal, particularly under the democratic socialist banner."[25]
